It is agreed that the terms set out below and used in conjunction with the booking form are the total agreement made between the parties and that no variation or modification of this contract shall be effective unless agreed by both parties in writing.
1. Payment Terms - A non-refundable deposit of £100.00 is required to reserve the date exclusively for your wedding. The remainder of the balance is due 28 days prior to the wedding. Daniel Wray [DCREATE] will attempt to remind the customer 7 days prior to the final balance being due and should the customer fail to pay by the due date specified in the booking form, Daniel Wray [DCREATE] reserves the right to take an alternative booking for the same date.
2. Special Requests & Coverage - The customer understands and accepts that the video coverage will be as the videographers expertise determines. Every effort is made to comply with the customers wishes however, special requests are not binding instructions.
Any special requests not notified within the booking form must be made by the customer to Daniel Wray [DCREATE].
3. Customer Names & Details - Daniel Wray [DCREATE] will use the exact customer (married) names & details for any products (such as wedding film, promotional material) as written within the booking form.
4. Unavoidable Circumstances - Due to unavoidable circumstances, if Daniel Wray [DCREATE] is unable to video your wedding for reasons such as illness or emergency, we reserve the right to terminate the contract and in this event all monies paid will be refunded in full.
5. Consent to Film - The customer is responsible for ensuring that all consents are given or obtained and that any required fees are paid which allow Daniel Wray [DCREATE] to carry out the agreed services. This includes, but is not limited to; permission to film in the chosen venues and permissions of persons involved in the event, including musicians, entertainers, DJs, performers etc.
The videographer reserves the right to use captured footage for promotional use.
6. Exclusivity - Daniel Wray [DCREATE] will be the exclusive professional videographer. Friends and family are permitted to operate video cameras provided that they do not limit the requirements of professional coverage.
7. Video Quality - Daniel Wray [DCREATE] will provide a pleasing colour balance but cannot guarantee exact colour matching or usage of footage where external forces (such as lighting) cannot be altered or controlled by the videographer. It is sometimes impossible to record exact colour as seen by the human eye.
8. Lighting Quality - Daniel Wray [DCREATE] will provide a well exposed image but cannot guarantee final quality or usage of footage where external forces (such as lighting) cannot be altered or controlled by the videographer. Normally it is requested that the dance floor lighting is slightly raised for the first dance in order to film it effectively. Sometimes this request is denied either by the venue or the customer. Such circumstances may result in the footage being under lit.
9. Audio Quality - Daniel Wray [DCREATE] will provide audio of the event recorded with shotgun microphones. In addition, it is normally requested that the Groom wears a lavalier microphone during the ceremony. Daniel Wray [DCREATE] cannot guarantee quality or usage of audio where external forces (such as interference, low audio sources, licensed music etc.) is captured during the filming process or where no lavalier microphone is worn.
10. Copyright Music - All music is subject to copyright laws and well known songs require large licensing fees for usage and distribution. Daniel Wray [DCREATE] reserves the right to disregard sections of audio where there is a risk of copyright infringement.
Daniel Wray [DCREATE] has access to a large selection of music through an online subscription service - Epidemic Sound. All musical selections for the final wedding film will be sourced from Epidemic Sound or other similar services.
11. Lack of Coverage - Daniel Wray [DCREATE] cannot be held responsible or provide refunds for the lack of coverage caused by any person of the wedding party being delayed for any reason, or on the policy of church, or licensed place of wedding, or adverse weather conditions which limit artistic scope or videography, or location limitations & restrictions.
The customer understands that the videographer may be unavoidably restricted during the ceremony, or other events, to comply with the rules of the officials conducting the ceremony and/or the venue hosting it. Restrictions may also be placed on the videographer due to the physical limitations of the event locations (such as room layouts, sizes, lighting etc.).
12. Access to the Venue - The customer is responsible for arranging access to venues at least 1 hour prior to the bridal preparations, ceremony & first dance.
13. Supply and Storage of your Wedding Film - It is agreed that it is the sole responsibility of the customer to backup and store the supplied digital video files for future use and long term safekeeping.
Your original wedding files are recorded in large, high quality 4K formats which must be converted for regular use and require large hard drives and systems of storage. Indefinite or continued capacity for long-term storage is costly.
Your original wedding files will be stored by Daniel Wray [DCREATE] for 6 months after delivery of the final wedding film. The original wedding files can be supplied to the customer during this time period for an additional fee.
The file of the final wedding film will be stored for 3 years after delivery of the final wedding film. The file of the final wedding film can be supplied to the customer during this time period for no additional fee.
No liability can be held for the loss or damage to files after these stated periods have ended.
12. File Format - Your files are delivered in a format (.mp4 or .mov) which makes it very simple to save to; storage devices, USB sticks, laptops or desktop computers etc. These files can be used to watch you wedding film on a TV or have it shared on social media and websites via phones and tablets etc. It can also be used to make Blu-ray or DVD copies.
No responsibility will be accepted for files which do not play in generic devices, however every effort is made to resolve this issue.
13. Editorial Control - Daniel Wray [DCREATE] will edit your film to professional standards and shall have final editorial control on the finished product in all cases.
14. Cancellation - The customer may cancel this contract at any time by giving written notice to Daniel Wray [DCREATE] and in doing so shall forfeit any moneys paid.
15. Limitation of Liability - In the unlikely event of a total videography failure, memory card failure, storage drive failure or cancellation of this contract by either party or in any other circumstance, the liability of one party to the other shall be limited to total value of the contract. Neither party shall be liable for indirect or consequential loss.
16. Finished Product - Upon taking possession of the finished product, the customer must inform Daniel Wray [DCREATE] of any technical or other problems with the video within 7 days. After 7 days, if no notification has been received, the customer will be deemed to be satisfied with the product.
17. Copyright - Copyright will be owned by Daniel Wray [DCREATE].
18. Health & Safety - Daniel Wray [DCREATE] and the customer will act in accordance with all relevant health and safety requirements in order to provide the product(s) or service(s). We do not normally use additional mains-operated lighting, mains power for cameras or cause trailing cables to be present, but reserve the right to do so.
19. Privacy & Confidentiality - Unless otherwise agreed, Daniel Wray [DCREATE] will treat any information gained during the supply of the product(s) or service(s) as being private and confidential. Likewise, the customer shall keep confidential any methodologies and technology used by Daniel Wray [DCREATE] to supply the product(s) or service(s).
Accepting these terms & conditions in addition to completing the online booking details & transferring your deposit, will form the contract for your selected wedding videography package supplied by Daniel Wray [DCREATE].
